1. Acceptance of Terms

By accessing or using Flexement's website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Services

Flexement provides a social media management platform that allows users to connect social media accounts, schedule and publish content, collaborate with team members, and access analytics and reporting. Features may vary by subscription plan and are subject to change as we improve the platform.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account, including actions taken by team members you authorize.
• You must notify us promptly of any unauthorized use of your account.

4. Connected Social Media Accounts

When you connect third-party social media accounts, you grant Flexement permission to access and use those accounts as needed to provide the Services, in accordance with the permissions you approve and the applicable platform's terms. You remain responsible for complying with each platform's policies and for the content published through your connected accounts.

5. Acceptable Use

You agree not to use the Services to:

• Violate any applicable law, regulation, or third-party rights.
• Post unlawful, harmful, misleading, defamatory, or infringing content.
• Send spam, engage in harassment, or distribute malware.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Reverse engineer, scrape, or interfere with the proper operation of the Services.
• Use the Services in a manner that could damage Flexement's reputation or infrastructure.

6. Content and Intellectual Property

You retain ownership of content you create, upload, or schedule through the Services ("Your Content"). You grant Flexement a limited license to host, process, transmit, and display Your Content solely to operate and provide the Services.

Flexement and its licensors own all rights in the platform, software, branding, and related materials. Nothing in these Terms grants you any rights to our intellectual property except the limited right to use the Services as permitted here.

7. Subscriptions and Payments

• Paid plans are billed according to the pricing and billing cycle shown at checkout or on our plans page.
• Fees are generally non-refundable except where required by law or explicitly stated in a promotion or plan description.
• We may change pricing with reasonable notice. Continued use after a price change constitutes acceptance of the new fees for subsequent billing periods.
• Failure to pay may result in suspension or termination of access to paid features.

8. Free Trials and Plan Changes

If we offer a free trial, it is provided at our discretion and may require a valid payment method. At the end of a trial, your account may convert to a paid plan unless you cancel before the trial ends. You may upgrade, downgrade, or cancel your subscription according to the options available in your account settings.

9. Service Availability

We strive to keep the Services available and reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, updates, third-party platform outages, or events beyond our control may affect availability. We are not liable for delays or failures in publishing caused by third-party networks or APIs.

10. Termination

You may stop using the Services and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or if we reasonably believe your use poses risk to the platform or others. Upon termination, your right to use the Services ends, though provisions that by their nature should survive will remain in effect.

11. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet your requirements or that results from social media activity will meet your expectations.

12. Limitation of Liability

To the fullest extent permitted by law, Flexement and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the Services. Our total liability for any claim related to the Services is limited to the amount you paid us in the twelve months preceding the claim, or one hundred U.S. dollars if you have not paid any fees.

13. Indemnification

You agree to indemnify and hold harmless Flexement from claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the Services, your violation of these Terms, or your violation of any third-party rights or platform policies.

14. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may also be communicated by email or in-app notice. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the Hashemite Kingdom of Jordan, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Amman, Jordan, unless otherwise required by applicable law.
